A. Visitors to our website – A visitor is any person visiting Concerto websites

Concerto is committed to respecting the privacy of visitors to our website. We do not automatically gather any personal information from visitors, such as their name, phone number, email or address during their visit to our website. This information is only obtained if supplied to us voluntarily, usually through contacting us via email and/or by then registering in a secure portion of our website.

Although we do use software that receives and records the Internet Protocol (IP) addresses of computers that have connected with our website, we make no attempt to link these addresses with the identity of individuals visiting our website. When you visit our website, our web server automatically logs your domain and notes what pages you view.

What do you use cookies for?

Cookies are a standard internet technology, and many major websites use them to provide useful features for their members. Cookies allow us to store and retrieve login information on a user's system. Cookies themselves do not personally identify users, although they do identify a user's computer. Most browsers are initially set up to accept cookies. If you'd prefer, you can set yours to refuse cookies. However, you may not be able to take full advantage of our web services if you do so.

B. Client Privacy – A client is an individual business engaging Concerto to provide research related services to them

Concerto will only divulge the identity of our clients with consent from our clients. Protection of our client’s information is very important to us, which is why any information obtained from our clients by any means is protected in a secure area of our website. Concerto will protect the personal information in its custody or control by making reasonable security arrangements to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks.  This information may be quantified for overall trending anonymously by Concerto and may be stored for further evaluation.

Concerto uses encryption technology to keep your password information safe. We supply our clients with unique individual identification (User ID) and passwords, so each client can access only the information they are allowed to view. Once we receive your information we store it on a server that isn’t accessible from the internet.

How secure is your hosting environment?

The information is stored in secure databases protected by network firewalls to prevent loss, misuse or alteration of confidential company information. Our web servers are locked in cages in an internet data center which offers the widest range of physical security features including state-of-the-art smoke detection and fire suppression systems, multiple climate controlled air conditioning units, anti-static flooring, as well as a 24/7 manned Network Operations Centre and video camera surveillance. Concerto uses industry standard technology to keep your personal information as safe as possible. Additionally, we have dedicated uninterruptible power systems, with multiple back-up generators, in case of power failure. As a further safety feature, all the data is backed-up on a daily basis.  Concerto will not be responsible for any damages that you suffer if you transmit confidential or sensitive information to us.

C. Shopper Privacy -  A Shopper is an Independent Contractor who has agreed to be on Concerto Shopper database to in order to apply for mystery shopping assignments for Concerto

We, at Concerto, understand and respect that your privacy should always remain strictly under your control. It is because of this philosophy that you can be confident that the information you divulge to us will not be accessible to people whom you have not authorized, nor will it be distributed to third parties unless consent has been granted. The purposes for collection of personal information are: to conduct quantitative or qualitative marketing and social research, to understand respondent opinions to establish suitability for further quantitative and qualitative marketing and social research, and to meet legal and regulatory requirements.

Concerto shall specify orally, electronically or in writing the identified purposes to the respondent at or before the time personal information is collected in a survey. Upon request, persons collecting personal information shall explain these identified purposes or refer the individual to a designated person within Concerto who can explain the purposes.

Does Concerto sell my information to third parties?

As a matter of policy, we do not sell, rent or lend any of your personal information to third parties without your consent, other than in accordance with this policy. However, the following describes some of the ways that your personal information may be used in the normal routine to provide our range of services to you.

Service Management. We use your personal information to provide the services you request. We use your personal information to: troubleshoot problems; measure consumer interest in our services, inform you about offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; and as otherwise described to you at the time of collection. Your email address will be provided to Paystone to process your payments as described on the Terms page. There is no specified time frame for retaining or destroying your personal data.

Law Enforcement. Concerto cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you and Concerto. Therefore, in response to a genuine request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can disclose personal information about you. Third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the website. Therefore, although we use industry standard practices to protect your privacy, we do not promise that your personal information or private communications will always remain private.

Acquisition. It is possible that as we continue to develop our website and our business, Concerto service and/or related assets might be acquired. Notwithstanding any provision in this policy to the contrary, in event of a merger or acquisition, your personal information may be transferred to the acquiring entity, and become subject to the acquirer's data practices.

How can I review my personal information Concerto has stored?

You can access your information using your personally selected User ID and Password, by clicking on the “My Contact Info” tab. You can update this information as necessary and we rely on you for its accuracy.

What safeguards are in place to ensure the security of my information?

With your personally selected User ID and Password you are assured that your information is protected from loss, theft, unauthorized access, disclosure, copying, use or modification. Concerto does not have access to your password but can assign temporary passwords. The only employees with access to your information are the Account Managers posting your assignments.

We have policies in place to ensure anyone contacting us to obtain a new password are who they say they are, and only assign temporary passwords ensuring Shoppers are always in control of their personal information.

Can I decline to have my personal information used for certain purposes?

You may decline being included in any number of Concerto mailing lists. You can decline being invited to participate in Panels, Focus Groups or Online Surveys by not filling in the Optional Information portion of our online application. Concerto shall investigate all complaints concerning compliance with its Privacy Policy. If a complaint is found to be justified, Concerto shall take appropriate measures to resolve the complaint including, if necessary, amending its policies and procedures. The respondent shall be informed of the outcome of the investigation regarding his or her complaint.

How will I be notified of changes?

We may amend this Privacy Policy at any time by posting the amended terms on the Website. All amended terms shall automatically be effective immediately after posting on the website.  It will be your responsibility to opt out if you no longer agree with our policy, by informing Concerto of your wishes.

D. Panel Member Privacy – A Panel Member is an individual not employed by Concerto who has agreed to be on Concerto panel database in order to participate in Concerto panels

If you choose to complete the Optional Information portion of our online application and respond to a panel posting we will ask for your consent to disclose to our client your personal information. The purposes for collection of personal information are: to conduct quantitative or qualitative marketing and social research, to understand respondent opinions to establish suitability for further quantitative and qualitative marketing and social research, and to meet legal and regulatory requirements.

In obtaining consent, Concerto shall use reasonable efforts to ensure that a respondent is advised of the identified purposes for which personal information will be used or disclosed. The identified purposes shall be stated in a manner that can be reasonably understood by the respondent.

You are free to choose whether or not to participate in a panel survey, to choose not to answers any specific questions and to discontinue participation at any time. The participation of a respondent in a quantitative or qualitative marketing or social research study may constitute implied consent for Concerto to collect, use and disclose personal information for the identified purposes.

Concerto shall specify orally, electronically or in writing the identified purposes to the respondent at or before the time personal information is collected in a survey. Upon request, persons collecting personal information shall explain these identified purposes or refer the individual to a designated person within Concerto who can explain the purposes.

Withdrawal. An individual may withdraw consent at any time, subject to legal or contractual restrictions, provided that reasonable notice of withdrawal of consent is given to Concerto. On receipt of notice of withdrawal of consent, Concerto will inform the individual of the likely consequences of the withdrawal of consent, which may include the inability of Concerto to provide the financial incentive for participation.

E. Survey Respondents Privacy -  A Survey Respondent is an individual not employed by Concerto who has agreed be on Concerto database in order to submit surveys to Concerto

If you choose to complete the Optional Information portion of our online application and respond to a Concerto invitation to complete a survey we will ask for your consent to disclose to our client your personal information. The purposes for collection of personal information are: to conduct quantitative or qualitative marketing and social research, to understand respondent opinions to establish suitability for further quantitative and qualitative marketing and social research, and to meet legal and regulatory requirements.

In obtaining consent, Concerto shall use reasonable efforts to ensure that a respondent is advised of the identified purposes for which personal information will be used or disclosed. The identified purposes shall be stated in a manner that can be reasonably understood by the respondent.

The purposes for collection of personal information are: to conduct quantitative or qualitative marketing and social research, to understand respondent opinions to establish suitability for further quantitative and qualitative marketing and social research, and to meet legal and regulatory requirements.

In obtaining consent, Concerto shall use reasonable efforts to ensure that a respondent is advised of the identified purposes for which personal information will be used or disclosed. The identified purposes shall be stated in a manner that can be reasonably understood by the respondent.

Definitions

Collection. The act of gathering, acquiring, recording, or obtaining personal information from any source, including third parties, by any means.

Consent.  Voluntary agreement for the collection, use and disclosure of personal information for defined purposes. Consent can be either expressed or implied and can be provided directly by the individual or by an authorized representative. Express consent can be given orally, electronically or in writing, but is always unequivocal and does not require any inference on the part of Concerto. Disclosure.  Making personal information available to a third party.

Employee.  An employee of Concerto.

Personal Information. Information about an identifiable individual, but does not include the name, title, business address or telephone number of an employee of an organization, and does not include descriptive, factual information about an organization.

Respondent.  A member of the public who provides personal information to Concerto in the course of participating in a panel or online survey conducted by Concerto. For example, a respondent is an individual who discloses personal information to Concerto in the course of quantitative or qualitative marketing or social research.

Third party.  An individual or organization outside of Concerto.

Use.  The treatment, handling, and management of personal information by and within Concerto or by a third party with the knowledge and approval of Concerto.
